Candidate Legal Disclaimer
This Legal Disclaimer ("Disclaimer") is issued by Platinum Nanny Ltd. ("The Agency") to candidates ("Candidates") whose registrations have been accepted. By signing this Disclaimer, the Candidate acknowledges and agrees to the following:
1. Role of The Agency
The Agency acts in accordance with The Employment Agencies Act 1973 as an intermediary, introducing Candidates to potential employers ("Clients"). The Agency is not the employer and has no involvement in the employment contract or relationship between the Candidate and Client. Its role is limited to facilitating introductions and is not responsible for the employment terms, obligations, or compensation between the Candidate and Client.
2. No Employment Relationship
In accordance with The Employment Agencies Act 1973, the Candidate understands that engaging with The Agency does not create an employment relationship between the Candidate and The Agency. The Agency’s role is solely as an intermediary introducing Candidates to Clients, without any employer-employee relationship, partnership, or legal agency established. The Agency does not act on behalf of the Candidate or the Client in any legally binding capacity.
3. No Liability for Salary or Benefits
Under The Employment Agencies Act 1973, The Agency is not responsible for any salary, wages, or benefits due to the Candidate from the Client. The Candidate agrees that all employment terms, including compensation, are exclusively between the Candidate and the Client. The Agency bears no responsibility or liability for payment or disputes related to remuneration, benefits, or other employment obligations.
4. Candidate’s Responsibility for Employment Contract
The Candidate acknowledges their sole responsibility to review, understand, and agree to the terms of any employment contract with the Client. The Agency is not involved in negotiating or enforcing the terms of the employment relationship. Any disputes, including those regarding salary, termination, or working conditions, are to be resolved directly between the Candidate and Client, with no involvement from The Agency.
5. Release of Liability
By engaging with The Agency, the Candidate releases The Agency from any claims or liabilities relating to:
- Non-payment of salary, wages, or benefits by the Client;
- Disputes arising from the employment contract, including working conditions, contract breaches, or termination;
- The Agency is not responsible for any issues or disputes between the Candidate and Client once the introduction has been made.
6. Confidentiality
The Candidate expressly agrees not to disclose, share, or distribute any details of the Clients, including but not limited to personal information, photographs, or any other details about the Clients or their families, children, or minors, to any third party. This obligation is to protect the privacy and safety of the Clients and their families. Any breach of this clause may result in legal action and potential damages. The Agency is not liable for any breaches of confidentiality by the Candidate.
7. No Guarantee of Employment
The Agency does not guarantee that an introduction will result in employment or engagement. The Candidate acknowledges that The Agency’s role is solely to facilitate introductions and that employment decisions are made by the Client alone.
8. Data Protection and Confidentiality
The Agency processes personal data in accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR). We always obtain your direct consent before sending your CV, contact details, and HR folders containing all employment and vetting documents supplied during registration to potential employers. Once introduced, the Client is responsible for handling your personal data in compliance with data protection regulations. 9. Applicable Law
This Disclaimer is governed by the laws of England and Wales, and any disputes arising from this Disclaimer shall be subject to the jurisdiction of the courts in England and Wales.
Important Notice
Candidates whose registrations are accepted by Platinum Nanny Ltd. will be required to digitally sign this disclaimer, confirming they have read, understood, and accepted the terms of these Legal Disclaimers in their entirety.
